The accused Alan MacDonald was arrested and charged with criminal offences relating to this occurence in February 2009.
In Superior Court last Friday November 6th 2009, he was found guilty of: (1) Fail to remain bodily harm, (2) Drive disqualified and (3) Breach of probation. He will be sentenced on Wednesday November 25th in Newmarket.

The Barrie Police Traffic Unit is actively investigating a Fail to remain motor vehicle collision involving a pedestrian that took place on February 8th, 2009 at approximately 2:30 am.
Our investigation reveals that the victim Joseph ROCHON, a 32 year old male from Elmvale, ON had attended 55 Special on Cedar Pointe Drive in Barrie. The victim left the establishment at approximately 2:12 am on February 8th and was walking to a friend’s house. As he was walking on Dunlop Street near Highway 400, he was struck by a motor vehicle and thrown into a snow bank. The driver who struck the victim fled the scene and left him critically injured in the snow bank, where he remained until he was found by a passer by around 8:00 am. He was found unconscious and eventually airlifted to St Michael’s Hospital in Toronto.

UPDATE:
On the 19th of February 2009 at approximately 6:30pm the Barrie Police Service Traffic Unit executed a Criminal Code Search Warrant at 40 Boys Street, Barrie.
The suspect vehicle, a 1996 Dodge Stratus, green was located inside the garage at this address. While the vehicle has been impounded for forensic testing at the Centre of Forensic Sciences, initial observations by investigating officers reveal that the state of this vehicle is consistent with the damages described by investigating officers.
Alan H MacDonald, 52 years of age has been charged with:
Breach Probation x 8
Drive while disqualified
Fail to Remain – (accessory after the fact)
(Not all of the charges stem from the date of the incident)
Mr. MacDonald will be appearing in Barrie Provincial Court on this date for a bail hearing.
Joseph ROCHON remains at St. Michael’s hospital, suffering from a fractured skull, two broken ribs and a broken collar bone. He is in stable condition, but is undergoing treatment as it relates to his head injury.
